Draft DPDP Rules, 2025: Online Gaming Platforms to Obtain Parental Consent

The Draft Digital Personal Data Protection Rules, 2025, released by the Ministry of Electronics and Information Technology (MeitY) on January 3, 2025, proposes additional measures for processing children’s data, encompassing securing verifiable parental consent and observing due diligence requirements to verify the age and identity of the parent or lawful guardian. Consequently, data fiduciaries, including online gaming intermediaries, must adopt these measures. The verification process envisaged under the Draft Rules is essential to confirm that consent is obtained from a responsible adult in accordance with applicable laws.[1] Examples are given to illustrate how this process should be carried out, especially in situations where the parent is already a registered user or when the parent must provide identity information through a Digital Locker service.
