Basketball Federation Challenges Antitrust Probe

The Basketball Federation of India (BFI) has approached the Delhi High Court to challenge the Competition Commission of India’s (CCI) antitrust investigation.[1]

The probe arises from allegations made by Elite Pro Basketball Private Limited, including denial of market access to organisers of basketball leagues and a September 2023 circular that restricted basketball players, referees, and coaches from participating in non-BFI-sanctioned events. After forming a prima facie view that BFI had contravened the provisions of the Competition Act, 2002, the CCI, through its November 2025 order, directed that an investigation be made.

Earlier this month, the BFI filed the present petition before the Delhi High Court challenging CCI’s order. It argued that the matter does not fall within the CCI’s jurisdiction, contending that, as a national sports federation, it cannot be investigated under competition law for its regulatory actions. The petition submits that the process of identifying partners through competitive and transparent bidding and raising funds for the development of the sport falls within the scope of policy and regulatory decisions and does not constitute economic activity subject to the provisions of the Competition Act.

BFI further submitted that warning players against participation in unrecognised leagues and competitions was a regulatory and policy decision aimed at maintaining discipline and ensuring compliance with international norms, including those prescribed by the International Basketball Federation.

The Court has sought the CCI’s response, and the matter will be heard next on March 10, 2026.
